Business Entity Choices:
Choosing what type of entity to use for your business can be an intimidating decision. Having an attorney to help with the process of formation can help to ease the process. In addition to my JD degree, I also have an MBA and experience running both LLC's and PC's.
There are many choices avaialbe in picking the structure of your company. Among the options available are S-Corporation, C-Corporation, Limited Liability Company (LLC), Professional Limited Liability Company (PLLC), Limited Liability Partnership (LLP), partnerships. Some occupations (for example medical doctors and lawyers) can also form what is called a Professional Corporation (PC) or a Professional Limited Liability Company (PLLC).
There are many factors to consider when choosing what type of entity to use for your business. Among those factors are having different ownership interests, how easy or difficult it may be in the future to convert to another type of entity, self-employment tax, the alternative minimum tax and estate planning.
Labor Board Cases:
When an employee, or former employee files a complaint with the Oklahoma Department of Labor you will receive a letter outlining the amount in dispute and the specific complaint alleged (typically non payment of wages).
You will also receive an Employee's Wage Claim and Employer's Wage Claim Response form. You have 15 days to complete and return the Employer Resonse Form. If you fail to do so, the Department of Labor may make a decision based upon the information in their file.
Hiring Practices:
As an employer, your initial hiring decisions will have a tremendous impact on your bottom line. There are alternatives to paying to have in depth background checks run on all your potential hires.
Your options include, but are not limited to, runing a court records search on OSCN.net, geting the applicant's consent and signature to send a background request to the Oklahoma State Bureau of Investigation and getting the applicant's consent to run a credit report.
